Brot: Stop using social media unless you’re confident what you are posting would be viewed favorably by a judge.
Always assume that what you say and what you do are being watched by someone who will describe it in detail to a judge. There are limits to the ability of lawyers to ensure full confidentiality although, from time-to-time, hearings can be closed to the public, upon request by a skillful lawyer.
2. Marriage.com: What are the benefits of using a private judge, and what to expect from this process?
Brot: One key benefit to using a private judge is the ability to schedule hearings or trial without regard to an overly taxed public court system, which is beset by delay.
However, the most popular private judges often become busy such that you cannot always schedule to your convenience. The second benefit of a private judge is that the proceedings are generally not observed by the public, so there is less risk of information finding its way to the public.
3. Marriage.com: How divorce coaches have played a more pivotal role in the divorce process?
Brot: Divorce coaches are a resource used in a small number of cases to help a party keep perspective on their own feelings, which may cloud decision-making.
An experienced divorce coach will help a party respond thoughtfully rather than react emotionally.
The best divorce coaches recognize the limits of their expertise and are there to assist their client with their own decision-making – not to make decisions for the client, or to take the place of a lawyer.
4. Marriage.com: What are the threats divorce poses to multigenerational wealth, and how to protect that wealth?
Brot: The threat to multigenerational wealth in a divorce proceeding significantly depends on the jurisdiction in which the case is found.
In most states, a parties’ separate property, including inherited property and trust beneficiary property created prior to marriage, is treated as separate property not to be divided in a divorce proceeding.
A well-drafted prenuptial agreement can ensure this result.
It is important for people with generational wealth to secure counsel before making decisions, and taking action to change the vesting of their property or the transfer of property into the community estate.
It is far more beneficial to ask what to do beforehand, rather than to turn for help after a mistake has been made.
